After assessing the documents contained in each envelope B, the Selection Committee has observed the following material defects in the following tenderers’ proposals:
1. NANOBEAM LIMITED:
a. The person who signs the proposal has not proved that he/she has authority sufficient to bind the undertaking on whose behalf he or she is tendering.
b. Lack of annual accounts filed at the Commercial Registry or at the relevant official registry. Alternatively, duly legalized books of account shall also be accepted.
2. ACCURION GMBH
a. Registration on the registers or the certificates contained in Annex IX to Directive 2004/18/CE must be sent translated into English.
b. The person who signs the proposal has not proved that he/she has authority sufficient to bind the undertaking on whose behalf he or she is tendering.
c. Lack of annual accounts filed at the Commercial Registry or at the relevant official registry. Alternatively, duly legalized books of account shall also be accepted.
3. OXFORD INSTRUMENTS
a. The person who signs the proposal has not proved that he/she has authority sufficient to bind the undertaking on whose behalf he or she is tendering.
b. Lack of annual accounts filed at the Commercial Registry or at the relevant official registry. Alternatively, duly legalized books of account shall also be accepted.

b. Absence of a statement of overall turnover and, where appropriate, of turnover in the area covered by the contract the last three financial years available, depending on the date on which the tenderer was formed or starting trading.

The Selection Committee has decided to afford the aforementioned tenderers a period of three business days to cure or remedy the defects observed, as set out in clause 11 of the Standard Specifications. The defects shall be notified to the tenderers in question by e-mail, and published in the INL contractor profile.
